Depending on what source you’re using, Tom Girardi is either suffering the effects of Alzheimer’s Disease or using the diagnosis as a way to circumvent being responsible for embezzling a lot of money. Erika Jayne’s soon-to-be ex is in a world of hurt and he is bringing his wife down with him. Viewers are beginning to get a glimpse of the legal dramatics Erika is about to enjoy on Real Housewives of Beverly Hills.

The discovery of Tom’s illness was recently brought into play by his team of defense attorneys who requested to place his brother, Robert Girardi, into a conservator position because of Tom’s declining health. The prosecution is said to be challenging this tactic, as the timing could be interpreted as suspicious. The true nature of Tom’s status is to be determined, but it doesn’t negate the fact that he has been seemingly defrauding clients for years. This week Tom went to court to try and regain control of the decisions made on his behalf.

I mean, if I were Tom, I would probably go ahead and let brother Robert take over at this point. How much worse could he make it? Patients suffering from Alzheimer’s Disease may have what are known as, “moments of clarity”. These flashes of lucidity can be incredibly brief, some last for hours, or perhaps even days at a time. At a court appearance this week, it appears Tom was cognitive enough to present his objection of the conservatorship to the judge. He was also able to submit a fully prepared statement.

According to Us Weekly, though we have heard Tom is basically unable to care for himself, he is apparently aware enough to know what he doesn’t want. Yesterday the former lawyer addressed the situation in court for the first time. “Obviously, I disagree with the conservatorship altogether,” Tom told the judge. He then detailed plans to end the conservatorship completely. “I think that we should put together the reasons why the conservatorship should be dissolved, and then we’ll address it, address the court,” Tom said.

While Tom wants to be rid of having handlers, the clients who never received money from him probably want things too. Like, oh, I don’t know, justice perhaps. Tom added, “Right now, I have nothing to say to the court.” Well, the court had something to say to Big Tommy. The judge ruled brother Robert should take over decisions about Tom’s health, healthcare, daily dealings, estate, and finances. No word on whether or not this includes a repeating chorus of “I told you so” from family members about getting involved with Erika, who may or may not have used embezzled funds to pay for male dancers honored with the task of stuffing her into latex onesies.

On the most recent episode of RHOBH, Erika mentioned Tom spending all of his time “at the Firm”. The approximate time of filming was late October 2020 and Erika filed for divorce November 3rd. By December 2020, reports began emerging of Tom being hospitalized for a “serious illness”. It is not known when the symptoms of mental decline appeared, but Tom’s defense team will attempt to determine his health played a significant factor in why victims of a plane crash did not receive settlement money. As for the people who have been trying to get money from Tom since 1995 when he was allegedly free of impairment, they’re still waiting.
